Cartpool Checkout Disclaimer (Legal Version)
By using Cartpool's services to initiate or complete a transaction, you ("User") expressly agree to the following terms, which supplement and incorporate Cartpool's Terms of Service and Privacy Policy. If you do not agree to all terms below, you must not proceed with the transaction.
1. Role of Cartpool
Cartpool is a third-party software and coordination tool that allows users to request assistance with online purchases through virtual assistant (VA) automation and manual intervention. Cartpool is not a retailer, distributor, reseller, or fulfillment provider. Cartpool does not own or possess any goods offered through the Platform and does not act as an agent for any vendor or merchant.
2. Authorization to Act on Your Behalf
By using Cartpool's checkout service, you explicitly authorize Cartpool, its virtual assistants, and its automated systems to act on your behalf for the limited purpose of completing purchases on third-party websites using the payment, shipping, and account credentials you provide. You assume full responsibility for the accuracy of that data and the legitimacy of the purchases.
3. No Guarantee of Completion
Cartpool makes no guarantees regarding the successful completion of any purchase. A transaction may fail for reasons outside Cartpool's control, including but not limited to:
• Out-of-stock items or pricing changes
• Payment processor errors or card declines
• Address verification mismatches
• Purchase restrictions by the merchant
In the event of failure, Cartpool may, at its sole discretion, issue a partial or full refund minus applicable service or administrative fees, but is not legally required to do so unless an internal system error directly caused the failure.
4. Assumption of Risk and Release of Liability
You understand and agree that all purchases are made at your own risk. By using Cartpool, you release and waive all claims, demands, and causes of action against Cartpool and its officers, employees, contractors, agents, and affiliates arising from or related to:
• Misdelivery, delay, or loss of goods by third-party vendors
• Denial of returns, disputes, or chargebacks by vendors
• Incorrect item selection or address entry made by the user
To the maximum extent permitted by applicable law, Cartpool disclaims all warranties (express or implied) and limits liability to the service fees paid for the failed transaction.
5. Refunds and Cancellations
Refunds are not guaranteed and are processed only when Cartpool fails to initiate a transaction due to internal error. Any disputes regarding product quality, refund eligibility, or shipment errors must be resolved directly with the third-party vendor. Cartpool will provide reasonable assistance but does not represent or act on behalf of third-party sellers.
6. Restricted and Prohibited Items
You acknowledge and agree that you will not use Cartpool to attempt to purchase items that:
• Require age verification or licenses that cannot be verified
• Are restricted by the seller's Terms of Use or applicable law
• Include weapons, controlled substances, or counterfeit goods
Cartpool reserves the right to block, cancel, or report such attempts to relevant authorities. Your account may be suspended or terminated for violations.
7. Payment Authorization and Data Security
You expressly consent to Cartpool storing and processing your payment, address, and authentication information in accordance with PCI-DSS security standards. You authorize Cartpool to use this information for:
• Transaction validation
• Fraud monitoring
Cartpool does not share or sell your information to unaffiliated third parties for marketing or profit.
8. Indemnification
You agree to indemnify, defend, and hold harmless Cartpool and its affiliates from any claims, liabilities, damages, costs, or legal expenses (including reasonable attorneys' fees) arising from:
• Violation of applicable law or third-party terms
• Inaccurate user information or account compromise
• Unauthorized or fraudulent activity initiated under your account
9. Binding Arbitration and Jurisdiction
Any dispute or claim arising from or relating to Cartpool's checkout service shall be resolved by binding arbitration in [Insert State/Country], under the rules of the American Arbitration Association. You waive your right to a jury trial or participation in class actions. This disclaimer and the services provided shall be governed by the laws of [Insert Jurisdiction].
10. Acknowledgement and Agreement
By proceeding with any checkout using Cartpool's services, you:
• Affirm that you are legally permitted to authorize such purchases
• Accept full legal and financial responsibility for the transaction
• Agree to abide by the Terms of Service, Privacy Policy, and this Disclaimer
If you do not agree to the terms above, do not proceed with any transaction using Cartpool.
